Sidrería Mizpiradi reserves the right not to attend to orders made by users that differ from the qualification of final consumer described above.
 

Products for sale

In www.mizpiradi.eus are for sale products and derivatives of the Basque cider sector and that are producers of natural cider with its corresponding RE.

The Sidrería Mizpiradi offer is divided into 3 sections: online cider store, meal reservations at the cider house and guided excursions.

Each product is accompanied by a detailed description of its main characteristics. Although Sidrería Mizpiradi takes the utmost care in reproducing its products, the images and colors of the products offered for sale may, however, not faithfully reflect reality, due to the specific characteristics of the Internet browser or screen used by the user.

Price of products on sale

The prices of the products on sale are determined in Euros and include the corresponding VAT.

1. Related to de cider store, to these prices it will be necessary to add, in its case the pertinent expenses of shipment, which will be communicated to the User before formalizing the order, and must be expressly accepted by the User when confirming the purchase.

Shipping costs will depend on the number of boxes purchased and the destination. These prices are indicated in the SHOP section of mizpiradi.eus. Shipping costs are free from the fifth box.

The prices can be updated at any time by Sidrería Mizpiradi, however, the prices applicable to each order will be those in force at the time the user confirms the purchase of the products being purchased.

2. In the case of meal reservations in the cider house, the user must pay an advance so that he can block a place. This advance will be deducted on the day of the reservation at the same cider house.

3. As far as excursions are concerned, the activity has its final price with VAT included and in direct sale with the payment of the all amount at the time of booking.

 

Formalization of the order of the products by the user

In order to conclude the purchase of the products, the user must follow the steps established in the purchase process; provide the data requested for this purpose; expressly accept these conditions of sale at the time of formalization of the same by confirming the order and proceed to full payment of the same at the time of confirmation.

Such data will be treated in accordance with the Privacy Policy expressed on this website.

The contract of sale will be understood to be formalized and perfected at the moment of the effective reception of the payment of the full price by Sidreria Mizpiradi.

Sidreria Mizpiradi may not process orders when they are incorrect, incomplete, or when the conformity of the payment has not been received within 48 hours following the placing of the order, in the event of unavailability of one or more products. The user will be informed by e-mail or telephone of the non processing of his order and the reasons for the non processing.

Once the order has been formalized and paid in full, the user will receive, within 24 hours, by e-mail a confirmation of the order detailing the order number, the products purchased and their prices, shipping costs, the method of payment chosen, the shipping address and other contractual data of the transaction.

The user can only cancel the order before the goods have left the Sidreria Mizpiradi warehouse.

Cancellations and changes in meal and excursion bookings

• Cancellations:

For bookings cancelled at least 24 hours (before12:00) in advance of the day booked, the amount of the deposit paid will be refunded. Any reservation cancelled within 23 hours before the reservation date won’t be able to refund any pre-paid fee.

• Changes:

Any necessary modifications may be made in meal and excursion bookings 24 hours in advance of the date booked, taking into account the availability of the cider house. In these cases:

• If there is an increase in the number of diners, the appropriate deposit must be paid. If the number of diners is reduced, the appropriate deposit will be refunded.
• If you wish to make any other changes in the last 24 hours before the day booked, you must contact Sidreria Mizpiradi on 943 59 39 54 or at mizpiradi.sagardoa@gmail.com.

Delivery of ordered products

Deliveries to the customer's home

The delivery time in Spain is 1 - 3 working days from the date of the order, except during promotional and holiday periods (long weekends, public holidays, Easter and Christmas) when this time could increase to a maximum of 10 working days due to the volume of orders and transport.

Sidreria Mizpiradi will deliver the products to the address that the user indicates in the order form, and that in any case must be within the territory indicated in clause 2 of the present sales conditions.

The delivery will be understood to have taken place from the moment in which the transport company makes the product available to the user.

If the package could not be delivered due to causes attributable to the user within the period of 10 working days following the departure of the package, it will be returned to Sidreria Mizpiradi at the user's expense for the cost of shipping and returning the goods to their origin, as well as any associated handling costs.

Right of withdrawal

The user may withdraw from the sales contract without any penalty and without indicating the reasons within a period of 7 calendar days from the date of receipt of the products purchased, informing Sidreria Mizpiradi of their decision to exercise their right of withdrawal by sending an email: mizpiradi.sagardoa@gmail.com. 

The return costs are to be paid by the user, except in the case of defective or incorrect products, in which case they will be paid by Sidreria Mizpiradi.

In order for the product on which the right of withdrawal is exercised to be accepted, it must be correctly protected, in its original packaging, in perfect condition for subsequent sale and retaining its labeling, and a copy of the delivery note must be included inside the package, where the returned products are marked.

The refund of the price of any payment received from the user for the returned product, including delivery costs will be made, without undue delay, by the same means of payment used in the payment of the product and within a maximum period of 14 calendar days from the time that Sidreria Mizpiradi has been informed of the user's decision to withdraw.

Sidreria Mizpiradi may withhold the refund until it has received the products or until the user has presented proof of the return of the goods, depending on which condition is met first, provided that Sidreria Mizpiradi has not offered to collect the products.

If the return cannot be accepted due to its lack of conformity with the conditions indicated above, the user will not be entitled to receive a refund of the amounts corresponding to the returned products, but will be entitled to have the non-conforming products returned to him/her at his/her own expense.

Product guarantee

Sidreria Mizpiradi guarantees the products acquired on its web site for a period of 18 months from the date of delivery.

The guarantee does not include deficiencies caused by negligence, blows, use or undue manipulation.

Applicable law and dispute resolution

The General Conditions of Sale set out here are subject to Spanish legislation.

In case of dispute over the interpretation, execution or validity of these general conditions of sale, the courts of the consumer's place of residence shall have jurisdiction.
